Court of Appeals

Premises Liability – Duty and Status (Unpublished)
Combs v Georgetown College , 2011 WL 2011 WL 3793410 (Ky.App. August 26, 2011)

The plaintiffs grandson was participating in a basketball camp in the Scott County High School gymnasium, and plaintiff was on the premises to watch. The bleachers were not pulled out, although some chairs were set out. No entrance fee was charged and concessions were not sold. There was no advertisement. The Court held that the plaintiff was on the premises with permission, but had not been invited. Accordingly, she was owed the duty afforded to a licensee, and was not entitled to expect that the premises would be prepared for her.
